SumSwift Terms of Service

Last updated October 23, 2026.

These Terms of Service ("terms") are a legal agreement between you and SumSwift Technologies Inc., a British Columbia corporation (incorporation number BC1613394) that runs SumSwift ("SumSwift", "we", "us" or "our"). They cover the SumSwift website at sumswift.com, the SumSwift app on the web and on iPhone, and everything SumSwift does for you (together, the "service").

Please read them. By creating an account, accepting an invitation, connecting a service, or paying for a plan, you agree to these terms and to our Privacy Policy. If you don't agree, don't use SumSwift.

1. Who can use SumSwift

  • SumSwift is a service for businesses and organizations, and for the accountants, bookkeepers, staff and employees who work with them. It isn't meant for personal or household use.
  • You must have reached the age of majority where you live (18 or 19 in Canada, 18 in most US states) and be able to enter a binding contract.
  • If you use SumSwift for a business or organization, you confirm that you have authority to bind it to these terms, and "you" means that business or organization as well as you.
  • You can't use SumSwift if you're barred from doing so under the laws of Canada, the United States or the place you live, including sanctions laws.

2. What SumSwift does

SumSwift is a bookkeeping service. You upload your bank, card and loan statements, receipts and bills, or connect your bank, inbox and other services, and SumSwift uses software, including artificial intelligence ("AI"), to read and sort your transactions, check them against the balances your bank reports, match receipts, bills and payments, and produce your books and reports: profit and loss, balance sheet, cash flow, sales tax and GST/HST figures, tax estimates and a year-end package for your accountant.

SumSwift also helps with the paperwork around your books, such as invoices and estimates you send your customers, bills and cheques, working out pay and the deductions for each payday (you pay your people and the government from your own bank), slips and return figures for you or your accountant to file, and connections to accounting software such as QuickBooks Online.

What SumSwift is not. SumSwift is not a public accounting firm, a chartered professional accountant, a tax preparer, a lawyer, a payroll service provider, a bank, a money services business or a financial adviser, and no professional relationship of that kind is created between us. We don't:

  • file tax returns, slips or other government filings for you;
  • give tax, accounting, legal, investment or financial advice;
  • audit, review or provide any assurance on your books or financial statements;
  • pay your bills, run your payroll, or hold, move or control your money.

Tax figures in SumSwift are estimates to help you plan and to help your accountant. They aren't a substitute for professional advice, and laws, rates and thresholds change. Answers from Ask Swift are information drawn from your own books, not advice. For tax, legal and financial decisions, talk to a qualified professional.

3. Your account and security

  • Give us accurate and complete information, and keep it up to date.
  • Keep your password, your email account and any device you sign in on secure. Don't share your sign-in. We recommend turning on two-step sign-in.
  • You're responsible for everything done through your account, including by people you give access to.
  • Tell us at once at hello@sumswift.com if you think someone has used your account without permission.
  • You can run more than one business under one login. Each business is a separate set of books.

4. Your responsibilities for your books

Software, including AI, can make mistakes, and the quality of your books depends on the records you provide. SumSwift checks every statement it can against your bank's balances, asks you about what it isn't sure of, and lists what it sorted on its own so you can review it. Even so, you are responsible for:

  • providing complete, accurate and lawful records, and only records you have the right to share with us;
  • answering what SumSwift asks, and reviewing your books, reports, figures and files before you rely on them or give them to anyone, including a tax authority, a lender, an investor or a buyer;
  • your tax and other government filings, slips, remittances and payments, and every decision about what to claim;
  • keeping your books and supporting records for as long as the law requires (in Canada, generally six years after the end of the tax year they relate to; in the United States, generally three to seven years). SumSwift is not a records-retention service. Download your records before you delete a business or your account.

If you find a mistake, you can fix it in the app, and SumSwift learns from the fix.

5. AI and automated features

SumSwift uses AI and other automated processes to read documents, sort transactions, match receipts and payments, flag possible double charges and risky bills, write summaries and answer questions. You understand that:

  • AI output can be incomplete or wrong, even when it looks confident. Review anything that matters.
  • Automated decisions affect your books, not your legal rights. You can see and change every one of them in the app.
  • Ask Swift only proposes changes. Nothing changes in your books until you confirm it, and you can undo it.
  • We send only what each task needs to our AI provider, which processes it on our behalf and doesn't use it to train its models (see the Privacy Policy). We don't use your records to train AI models either.
  • Don't upload documents that contain instructions meant to manipulate SumSwift or its AI.

6. Plans, payment and renewal

  • Monthly plan: $79 a month for up to 3 accounts, plus $10 a month for each additional account in use, billed monthly in advance; or paid yearly, $790 a year plus $100 a year for each additional account, billed yearly in advance. It covers your books from the month your plan starts and the 2 months before it, and every month after that while your plan is active. If you cancel and come back more than a week later, the plan starts over.
  • Catch-up: $599, paid once, adds the 12 months before what the Monthly plan covers, for up to 3 accounts. Each extra year further back is $299, paid once, up to 4 years in all. Larger jobs are quoted separately in writing.
  • Currency: prices are in Canadian dollars, or in US dollars for businesses in the United States.
  • Automatic renewal: the Monthly plan renews automatically each month, or each year if you pay yearly, and you authorize us (through our payment processor) to charge your payment method on file each billing period until you cancel. Your receipts show the amount and the next billing date.
  • Taxes: prices don't include sales taxes such as GST/HST, PST or QST. We add them where the law requires.
  • Failed payments: if a payment fails, our payment processor will retry it. If it still can't be collected, we may limit or suspend paid features until it is.
  • Codes, trials and firm-paid plans: a code or offer from us can include free months, under the conditions we state with it. An accounting firm can pay for your plan; if it stops, you get 30 days to choose your own plan before paid features stop.
  • First-month guarantee: if your books aren't right, tell us within 30 days of your first payment and we'll refund your first month (or your Catch-up, if we can't deliver it).
  • Cancelling: you can cancel any time in the app (Account > Plan). Your plan runs to the end of the period you've paid for and doesn't renew. Apart from the guarantee or where the law requires otherwise, payments are non-refundable and we don't refund partial periods.
  • Price changes: we'll give you at least 30 days' notice by email before a price change applies to you. It applies from your first billing period after the notice. If you don't agree, cancel before then.
  • Payment processing: payments to SumSwift are processed by Stripe. We never see or store your full card number.

7. Your data

You own your data. Your records, books and everything you upload or create in SumSwift ("your data") remain yours. You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display your data only as needed to provide, secure and support the service for you, to follow your instructions (for example, sending an invoice to your customer), and to comply with the law. This licence ends when your data is deleted, except for copies we must keep by law or that remain for a short time in backups.

Learning from corrections. When you tell SumSwift what a merchant is (for example, that a "SHELL" charge is fuel), that choice can be pooled with other businesses' choices for the same merchant to sort transactions better for everyone. Only the merchant's name, the category and how many businesses chose it are kept; never amounts, dates, account details or which business chose it. A merchant is used only once enough businesses agree, and payments to people (e-transfers, cheques, transfers) are never pooled.

Statistics. We may create statistics from use of the service that can't identify you, your business or anyone in your records (for example, how many statements were read in a month) to run and improve SumSwift.

Export and deletion. You can download your books at any time (spreadsheets, the year-end package, a QuickBooks export, or one file with all your records) and delete a business or your whole account yourself in the app. How deletion works is described in the Privacy Policy.

8. Personal information in your records

Your records contain personal information about other people, such as your customers, suppliers, employees, contractors, donors, tenants and clients. For that information:

  • You're in charge of it. You decide why it's collected and how it's used. You confirm that you collected it lawfully, that you have given any notices and obtained any consents the law requires to share it with SumSwift and to have it processed as described in our Privacy Policy, and that you'll only ask us to process it lawfully.
  • We process it for you. We use it only to provide the service to you and as you instruct, keep it confidential, protect it with the safeguards described in the Privacy Policy, and require our service providers to do the same.
  • We help you meet your duties. If someone asks you for access to or correction of their information in your books, you can do it in the app; if you need our help, ask us. We'll tell you without undue delay if we learn of a breach of security safeguards affecting it, so you can meet your own obligations.
  • Deletion. When you delete it, or your account, we delete it as described in the Privacy Policy.
  • Don't upload information SumSwift doesn't need, such as social insurance numbers, social security numbers, health records or full card numbers, except where a SumSwift feature asks for it.

9. People you give access to

You can give accountants, bookkeepers, staff and employees access to your books and choose what each person can do. Every change is recorded under the person's name, and you can remove anyone at any time. You're responsible for who you invite and for what they do in your books. Each person you invite must accept these terms to use SumSwift.

If you signed up through an accountant's link or invitation, SumSwift asks whether you want to share your books with them; sharing is always your choice. That accountant may receive a share of what you pay SumSwift under our Partner Program terms.

10. Things SumSwift does on your behalf

  • Emails to your customers and team. When you email an invoice, estimate, statement or reminder from SumSwift, or turn on automatic reminders, SumSwift sends it on your behalf. You're responsible for its content and for having the right to email those people, including under Canada's anti-spam legislation (CASL) and US law.
  • Getting paid online ("Pay now"). Payment processing services for businesses on SumSwift are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. By setting up Pay now, you agree to be bound by that agreement, as Stripe may modify it from time to time. As a condition of SumSwift enabling payment processing through Stripe, you agree to give SumSwift accurate and complete information about you and your business, and you authorize SumSwift to share it, and transaction information about your use of Stripe's services, with Stripe. Money goes from your customer to your own Stripe account and then to your bank. SumSwift never holds it and isn't responsible for refunds, chargebacks, disputes or Stripe's fees. SumSwift's fee: on each card payment, SumSwift charges 0.5% of the amount paid, on top of Stripe's fees, taken from the payment by Stripe; bank payments carry no SumSwift fee. The fee isn't returned if you refund the payment. We'll give at least 30 days' notice before changing it.
  • Online estimates. Your customers can accept an estimate online and sign it. This records their agreement; it isn't a certified electronic signature service, and you're responsible for whether it meets your needs.
  • Bill checks. SumSwift looks for signs of fraud in bills (a new supplier, a look-alike name, a resent or old invoice, an unusual amount) and holds risky ones until you answer. These checks lower the risk but can't catch every fraud. Check bills before you pay them.
  • Files for tax authorities. SumSwift can prepare slip files and return figures for you or your accountant to review and file. You're responsible for checking, filing and paying. Identification numbers you type to build a slip file stay on your device and aren't saved by SumSwift.

11. Connected services

SumSwift can connect to services run by other companies, such as your bank (through Plaid), your email (Gmail or Outlook), QuickBooks Online, Stripe, and online stores and payment services. When you connect one:

  • You authorize SumSwift to access it on your behalf and to read the information described in the app and the Privacy Policy and, where the app says so (for example, sending entries to QuickBooks Online), to write to it.
  • Bank connections. SumSwift uses Plaid Inc. ("Plaid") to gather your data from financial institutions. By using this feature, you grant SumSwift and Plaid the right, power and authority to act on your behalf to access and transmit your personal and financial information from your financial institution. You agree to your personal and financial information being transferred, stored and processed by Plaid in accordance with the Plaid End User Privacy Policy. SumSwift never sees your bank password and can't move money.
  • Those services are provided by their own companies under their own terms and privacy policies, which you must follow. We don't control them and aren't responsible for their availability, accuracy, fees or actions, or for information they provide that is wrong or late.
  • You can disconnect any connection at any time. What was already brought into SumSwift, or sent to another service, stays unless you remove it.

12. The iPhone app

If you use SumSwift's app for iPhone, these extra terms apply between you and SumSwift:

  • These terms are between you and SumSwift only, not Apple Inc. ("Apple"). SumSwift, not Apple, is solely responsible for the app and its content.
  • Your licence to use the app is limited to a non-transferable licence to use it on Apple-branded products you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions.
  • SumSwift, not Apple, is solely responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance or support for it.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are SumSwift's responsibility, to the extent these terms don't exclude them.
  • SumSwift, not Apple, is responsible for addressing any claims from you or a third party about the app or your possession or use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the app or your possession and use of it infringes their intellectual property rights, SumSwift, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you're not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you're not on any US Government list of prohibited or restricted parties.
  • You must comply with any third-party terms that apply when you use the app (for example, your wireless data agreement).
  • Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
  • Questions, complaints or claims about the app go to SumSwift at the contact details in section 24.

13. Acceptable use

Don't, and don't let anyone else:

  • break any law or anyone's rights, or use SumSwift for fraud, money laundering, tax evasion or to deceive anyone, including a tax authority, lender or buyer;
  • upload records you have no right to share, or malware, or content meant to manipulate the AI;
  • send spam or misleading messages through SumSwift;
  • try to access accounts, books or data that aren't yours, or probe, scan or test the service's security without our written permission (to report a security issue, email hello@sumswift.com);
  • interfere with or overload the service, get around its limits, or use bots or scrapers on it, except through features we provide;
  • copy, modify, resell, rent or build a competing product from the service, or reverse engineer it except where the law allows despite this restriction.

14. SumSwift's property

The service, including its software, design, text, graphics, logos and the SumSwift name, belongs to SumSwift or its licensors and is protected by law. Subject to these terms, we give you a limited, non-exclusive, non-transferable, revocable right to use the service for your business while your account is in good standing. We keep all other rights. If you send us feedback or ideas, we may use them freely and without obligation to you.

15. Confidentiality

We treat your data as confidential, use it only as these terms and the Privacy Policy allow, and protect it with reasonable safeguards. We may disclose it when the law requires (for example, a court order), and where allowed we'll tell you first so you can object. You'll keep any non-public information about the service that we share with you confidential.

16. Early access, changes and availability

  • SumSwift is in early access. Some features are labelled "coming soon", "beta" or similar, may change, and may be less reliable. Use them at your own risk.
  • We improve and change SumSwift over time and may add, change or remove features. If a change materially reduces what your paid plan includes, we'll tell you in advance and you may cancel and get a pro-rated refund of any prepaid period you haven't used.
  • We work to keep SumSwift available but don't promise that it will be uninterrupted, timely or free of errors. It may be unavailable during maintenance or because of things outside our control.
  • Support is by email at hello@sumswift.com and through Help & feedback in the app.

17. Suspension and ending

  • By you: you can stop using SumSwift, cancel your plan and delete your account at any time.
  • By us: we may suspend or end your access, in whole or in part, if you breach these terms, don't pay, use the service in a way that risks harm to SumSwift, other customers or anyone else, or if the law requires. Where reasonable, we'll give notice and a chance to fix the problem first. We may also stop offering SumSwift altogether with at least 60 days' notice and a pro-rated refund of any prepaid period you haven't used.
  • Your data afterwards: unless we ended your account for a serious breach or the law prevents it, we'll give you at least 30 days after we end your account to download your data, after which it's deleted as described in the Privacy Policy. When you delete your account yourself, deletion is immediate.
  • Sections that by their nature should continue (including 7 to 8 for data already processed, 14, 15 and 18 to 23) survive the end of this agreement.

18. Disclaimers

To the maximum extent permitted by law, the service, including all books, reports, tax figures, estimates, files, summaries and answers it produces, is provided "as is" and "as available". SumSwift disclaims all warranties and conditions, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and that the service will be uninterrupted, secure or free of errors. You're responsible for reviewing anything you rely on. Some jurisdictions don't allow some of these exclusions, so some may not apply to you.

19. Limitation of liability

To the maximum extent permitted by law:

  • SumSwift and its directors, officers, employees and contractors won't be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, savings, goodwill or data, business interruption, or taxes, interest, penalties or assessments imposed on you, however caused and even if we were told they were possible;
  • SumSwift's total liability for all claims relating to the service or these terms is limited to the greater of the amount you paid SumSwift in the 12 months before the event giving rise to the claim, and $100 CAD.

These limits apply to any theory of liability, including contract, tort (including negligence) and statute, and even if a remedy fails of its essential purpose. They don't limit liability that can't be limited by law, including for fraud, gross negligence or wilful misconduct, or for death or personal injury caused by negligence.

20. Indemnity

You'll defend, indemnify and hold harmless SumSwift and its directors, officers, employees and contractors from claims, losses, damages and reasonable costs (including legal fees) brought by a third party arising from: your data, including records you uploaded without the right to; messages you send through SumSwift; your use of the service in breach of these terms or the law; or your tax filings and other dealings with authorities, lenders, buyers or others based on your books. We'll tell you promptly about any such claim, let you control its defence (you can't settle it in a way that admits fault for us without our consent), and give reasonable help at your cost.

21. If you're a consumer

SumSwift is meant for businesses. If the law treats you as a consumer anyway (for example, as a sole proprietor in some provinces or states), you keep every right that consumer protection laws give you and that can't be waived, and anything in these terms that conflicts with those rights doesn't apply to you. In Quebec, the limitations in sections 18 to 20 don't apply to consumers to the extent the Consumer Protection Act prohibits them.

22. Disputes and governing law

  • Talk to us first. Most problems can be sorted out quickly. Before starting a legal claim, email us at hello@sumswift.com with a description of the problem, and give us 30 days to try to resolve it.
  • Governing law: these terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods doesn't apply.
  • Courts: you and we agree to the exclusive jurisdiction of the courts of British Columbia, except that either of us may bring a claim in small claims court where it qualifies, and either of us may seek urgent relief in any court to protect intellectual property or confidential information. If the law where you live gives you the right to bring a claim in your own courts, that right isn't affected.
  • Time limit: to the extent the law allows, a claim must be started within two years after the facts giving rise to it were discovered or ought to have been discovered.

23. General

  • Changes to these terms. We may update these terms. We'll post the new version with its date and, for material changes, give at least 30 days' notice by email or in the app before they apply. If you keep using SumSwift after that, the new terms apply; if you don't agree, cancel before then. Changes required by law, or that only add features or fix wording, can apply sooner.
  • Electronic communications. You agree that we may send notices, receipts and other communications to the email address on your account or in the app, and that they satisfy any requirement that they be in writing. Notices to us go to hello@sumswift.com.
  • Assignment. You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition, reorganization or sale of assets, with notice to you.
  • Things outside our control. We aren't responsible for delays or failures caused by events beyond our reasonable control, such as outages of internet, hosting, AI or banking providers, natural disasters, war, government action or labour disputes.
  • No waiver; severability. If we don't enforce a term, we haven't waived it. If a term can't be enforced, it's limited to the minimum extent necessary and the rest stays in effect.
  • Relationship. We're independent parties. These terms don't create a partnership, employment, agency, fiduciary or professional relationship.
  • Third parties. Except for Apple as described in section 12, no one else has rights under these terms.
  • Language. The parties have required that these terms and related documents be drawn up in English. Les parties ont exigé que ces conditions et les documents qui s'y rattachent soient rédigés en anglais.
  • Whole agreement. These terms, the Privacy Policy, any order or quote you accept, and (for accounting firms in the program) the Partner Program terms are the whole agreement between us about SumSwift and replace any earlier agreement on the subject. If they conflict, these terms prevail unless the other document expressly says otherwise.
